BAK-SEN Called for Abolition of the 2% Trade Union Threshold

The Confederation of Independent Civil Servants' Unions applied to the Constitutional Court for the abolition of the 2% trade union threshold.

The Confederation of Independent Civil Servants' Unions (BAK-SEN) applied to the Anayasa Mahkemesi (Constitutional Court) seeking the abolition of the 2% trade union threshold applicable to the collective agreement bonus.

The regulation in question stipulated that, for a civil servant to receive a collective agreement bonus, the union to which the employee belongs must have reached a membership rate of at least 2%. BAK-SEN challenged this condition on the grounds that it restricts trade union freedoms and is contrary to the Constitution.
